About Divìn Artistry

Divìn Artistry is a luxury beauty and production company providing professional makeup artistry, photography, videography, editorial services, creative direction, and related media experiences.

These Terms of Service apply to all bridal, event, photography, videography, production, editorial, destination, and creative services provided by Divìn Artistry unless otherwise stated within a separate Service Agreement.

By booking services with Divìn Artistry, the Client acknowledges and agrees that they have reviewed and accepted the policies, procedures, and expectations outlined within these Terms of Service.

Definitions

For the purposes of these Terms of Service, the following definitions apply:

"Client" refers to the individual, couple, organization, company, or authorized representative booking services with Divìn Artistry.

"Scheduled Service Date" refers to the date on which Divìn Artistry is contracted to provide services, including but not limited to weddings, events, productions, photography sessions, videography sessions, appointments, and creative projects.

"Service Agreement" refers to any written agreement, proposal, invoice, booking agreement, or contract executed between Divìn Artistry and the Client outlining the services, expectations, payment obligations, and responsibilities of both parties.

"Divìn Artistry Team" refers to the creative professionals assigned to fulfill the Client's Service Agreement, which may include makeup artists, photographers, videographers, assistants, coordinators, production personnel, and other creative professionals.

Client Health & Allergies

For the safety and comfort of all Clients, it is the Client's responsibility to disclose any allergies, sensitivities, skin conditions, medical concerns affecting services, or adverse reactions related to makeup products, skincare, fragrances, adhesives, or ingredients prior to the Scheduled Service Date.

Allergy and sensitivity information is discussed during the consultation process. By proceeding with a booking, the Client confirms that all relevant information has been fully and accurately disclosed.

Divìn Artistry is not responsible for reactions, irritation, discomfort, injuries, or other issues resulting from undisclosed, incomplete, or inaccurate information provided by the Client.

The Client acknowledges that professional products and materials are selected based on the information provided and that failure to disclose relevant sensitivities may impact the ability to safely perform services.

Consultations & Service Planning

To ensure a seamless and personalized experience, Divìn Artistry offers consultations as the first step in planning most bridal, photography, videography, production, and creative-event services.

Consultations are conducted remotely via phone call, video conference, email, or written communication, including text messages. Consultations are not considered in-person appointments unless otherwise arranged in writing.

Consultations are generally available Monday through Thursday. Weekend consultations may be accommodated upon approval and availability.

The consultation fee is $25 and serves as a dedicated planning session designed to discuss event details, project goals, timelines, logistics, creative direction, service requirements, and expectations.

The consultation allows Divìn Artistry and the Client to establish clear communication, understand the Client's vision, and determine the appropriate services needed to create a successful experience.

For Clients who choose not to participate in a consultation, services may still be booked provided that the Client signs any applicable Service Agreement and submits the required payment.

By declining a consultation, the Client accepts responsibility for communicating all relevant details, expectations, timelines, and creative preferences without the benefit of a dedicated planning session.

Completion of a consultation does not constitute a booking and does not reserve a Scheduled Service Date.

Services are considered confirmed only upon receipt of the required payment and any applicable signed Service Agreement.

Booking, Payment & Reservation Policy

A non-refundable deposit equal to sixty percent (60%) of the total service investment is required to secure applicable bookings unless full payment is made at the time of booking.

Invoices are issued for all payments.

Any remaining balance must be paid according to the payment schedule outlined within the Client's invoice or Service Agreement.

If a remaining balance is not paid by the designated due date, Divìn Artistry reserves the right to charge the payment method on file.

Reservation of a Scheduled Service Date prevents Divìn Artistry from accepting other bookings for the same date and time. For this reason, deposits, reservation fees, and consultation fees are non-refundable except as expressly outlined within these Terms of Service.

The Client acknowledges that booking with Divìn Artistry reserves creative time, resources, preparation, and availability specifically for their service.

Bridal, Event & Production Bookings

A signed Service Agreement is required for all bridal, production, destination, and bundled service bookings.

A sixty percent (60%) non-refundable deposit is required to secure the Scheduled Service Date.

No later than four (4) weeks prior to the Scheduled Service Date, the remaining balance, final participant count, selected services, package details, timeline, locations, and all associated fees must be confirmed and finalized.

Bookings made within four (4) weeks of the Scheduled Service Date require full payment at the time of booking.

To ensure a seamless experience and successful execution of services, all booking details are considered finalized after the four-week deadline.

Any requested modifications, additions, removals, participant changes, timeline adjustments, location changes, or package revisions thereafter may only be considered upon written approval from Divìn Artistry and are subject to availability.

Approval of requested changes is not guaranteed, and additional fees may apply.

Bridal Trial Appointments

Bridal trial appointments are considered standalone services and do not reserve a Scheduled Service Date.

Completion of a bridal trial does not guarantee future booking availability or confirmation of wedding-day services.

A bridal trial allows the Client and Divìn Artistry to collaborate on the desired bridal look, discuss preferences, and refine the overall beauty vision. While Divìn Artistry will make every effort to achieve the Client's desired result, final application outcomes may vary based on individual features, skin type, products, environmental factors, and other circumstances.

Wedding-day services are only confirmed upon receipt of a signed Service Agreement and required booking payment.

Bridal trials are subject to Divìn Artistry's standard booking, payment, cancellation, and rescheduling policies.

Individual Wedding Party & Event Participant Services

Bridesmaids, wedding-party members, family members, guests, talent, models, production participants, or individuals who book services separately from a primary bridal, production, or event agreement are considered standard-service Clients.

These services remain subject to Divìn Artistry's standard booking, payment, cancellation, refund, and rescheduling policies regardless of the event or project with which they are associated.

Individual participant services do not automatically reserve additional time, staffing, or resources unless included within a signed Service Agreement.

Final participant counts and requested services must be confirmed by the deadline outlined within the applicable Service Agreement.

Photography, Videography & Production Services

Divìn Artistry will make every reasonable effort to capture and deliver the moments, content, and creative deliverables discussed during the consultation process or outlined within the signed Service Agreement.

The Client understands that photography, videography, and production services are influenced by various factors, including but not limited to weather conditions, venue restrictions, lighting conditions, scheduling delays, participant cooperation, equipment limitations, technical issues, and circumstances outside of Divìn Artistry's reasonable control.

While Divìn Artistry strives to provide a professional and elevated creative experience, specific images, footage, moments, poses, angles, scenes, or creative outcomes cannot be guaranteed.

The Client acknowledges that successful production requires cooperation from the Client, venue, vendors, participants, and any individuals involved in the Scheduled Service Date.

Creative expectations, artistic interpretation, and final presentation are further outlined within the Creative Process & Artistic Expectations section.

Creative Process & Artistic Expectations

Divìn Artistry approaches each service with a personalized and artistic perspective. The Client understands that makeup artistry, photography, videography, editing, and creative production involve professional interpretation, artistic judgment, and creative decision-making.

Reference images, inspiration materials, mood boards, and creative examples provided by the Client are used as guidance to understand preferences and overall vision. However, exact replication of another artist's work, photographs, editing styles, lighting, poses, trends, or creative concepts cannot be guaranteed.

Factors including but not limited to individual features, skin type, lighting conditions, location, weather, wardrobe, environment, timing, equipment, participant cooperation, and production circumstances may influence the final result.

Divìn Artistry is committed to delivering a professional experience and creating work that aligns with the Client's communicated vision while maintaining the artistic integrity and professional standards of the Divìn Artistry brand.

Final creative decisions regarding styling, composition, editing, color correction, retouching, and presentation remain at the professional discretion of Divìn Artistry.

Media Delivery Timeline

Final edited photography galleries will be delivered within three (3) to four (4) weeks following the Scheduled Service Date unless otherwise stated within the Service Agreement.

Final edited videography projects will be delivered within four (4) to six (6) weeks following the Scheduled Service Date unless otherwise stated within the Service Agreement.

Delivery timelines begin on the first business day following the Scheduled Service Date.

Delivery timelines may be extended due to circumstances beyond Divìn Artistry's reasonable control, including but not limited to severe weather, venue restrictions, technical difficulties, emergencies, illness, equipment issues, or unusually high seasonal demand.

The Client will be notified if a significant extension becomes necessary.

Creative Ownership, Final Deliverables & Usage Rights

Divìn Artistry retains ownership and creative rights to all original photographs, video footage, edited content, creative concepts, production materials, and other works created during the fulfillment of services.

The Client receives access to the final edited deliverables included within their selected package or Service Agreement.

Delivery of final content grants the Client personal usage rights for sharing, printing, displaying, and enjoying the completed work for personal purposes unless otherwise stated within the Service Agreement.

Raw files, unedited photographs, unedited video footage, project files, source files, and behind-the-scenes production materials remain the exclusive property of Divìn Artistry and are not included unless specifically purchased or agreed upon in writing.

The Client may not alter, edit, filter, reproduce for commercial purposes, sell, license, submit for publication, or distribute Divìn Artistry's creative work without prior written permission.

For commercial, promotional, editorial, brand, or production projects, usage rights and licensing terms will be outlined separately within the applicable Service Agreement.

Divìn Artistry maintains the right to use completed work for portfolio, marketing, promotional, educational, publication, and social media purposes as outlined within the Creative Portfolio & Media Usage section.

Cancellations & Rescheduling

Cancellation or rescheduling requests must be submitted in writing.

For standard services, requests must be received at least forty-eight (48) hours prior to the Scheduled Service Date.

For bridal, photography, videography, production, destination, and event services, requests must be received no later than four (4) weeks prior to the Scheduled Service Date.

All deposits, reservation fees, and consultation fees are non-refundable and non-transferable.

Divìn Artistry will make reasonable efforts to accommodate approved rescheduling requests; however, future availability cannot be guaranteed.

If a rescheduled date is unavailable, the Client understands that the original booking payment remains subject to the cancellation policies outlined within these Terms of Service.

Cancellation Due to Exceptional Circumstances

Divìn Artistry understands that unforeseen circumstances can arise. In the event of a documented emergency, serious illness, family emergency, natural disaster, military deployment, or other significant unforeseen circumstance, Divìn Artistry may, at its sole discretion, consider a partial refund of amounts paid beyond any non-refundable deposits, consultation fees, administrative fees, travel expenses, or services already rendered.

All requests must be submitted in writing and accompanied by reasonable supporting documentation.

Because each situation is unique, refund determinations are made on a case-by-case basis and may take into consideration planning time, resources reserved, expenses incurred, services completed, and the proximity of the cancellation to the Scheduled Service Date.

Approval of any refund request is not guaranteed.

Appointment Timing & Schedule Integrity

Timeliness is essential to maintaining a seamless and elevated client experience.

The Client agrees to arrive or be available at the scheduled time communicated by Divìn Artistry.

Arrivals more than fifteen (15) minutes late may result in reduced service time, modifications to scheduled services, or cancellation when necessary to preserve the schedule of other Clients or event obligations.

No refunds, credits, or discounts will be issued for time lost due to Client delays.

For events, productions, and wedding services, the Client acknowledges that maintaining the agreed timeline is essential to achieving the intended service experience.

Travel, Destination & On-Location Services

Divìn Artistry operates as a mobile beauty and production team and proudly serves Clients locally, nationally, and internationally.

Travel fees apply to services performed outside of Divìn Artistry's designated service area and will be discussed during the consultation and booking process.

For destination weddings, productions, events, or creative projects requiring out-of-state or international travel, additional expenses may apply, including but not limited to:

  • Transportation

  • Lodging accommodations

  • Parking fees

  • Permits

  • Baggage fees

  • Meals

  • Additional travel-related expenses required to successfully provide services

To maintain the quality, efficiency, and professionalism of the Divìn Artistry experience, destination bookings include a minimum of two (2) Divìn Artistry Team members.

Additional artists, photographers, videographers, assistants, coordinators, or production personnel may be added upon request and are subject to additional fees.

All travel-related expenses must be approved by the Client and reflected within the final Service Agreement.

Service Environment Requirements

The Client agrees to provide a clean, safe, and suitable environment for services to be performed.

For makeup services, this includes:

  • Adequate lighting

  • Seating

  • Electrical access when needed

  • Appropriate workspace for professional application

For photography, videography, and production services, the Client is responsible for securing venue permissions, access approvals, permits, and any necessary authorizations unless otherwise agreed within the Service Agreement.

Divìn Artistry reserves the right to modify, suspend, or decline services if conditions are determined to be unsafe, unsanitary, hazardous, or otherwise unsuitable for professional service delivery.

Vendor & Venue Cooperation

The Client is responsible for ensuring that Divìn Artistry has reasonable access, cooperation, and permission to perform contracted services at the Scheduled Service Date location.

Divìn Artistry is not responsible for delays, missed moments, reduced coverage, incomplete deliverables, or limitations caused by venue restrictions, vendor interference, guest interference, lack of access, schedule changes, or circumstances outside of Divìn Artistry's reasonable control.

The Client acknowledges that successful service execution requires cooperation from the Client, venue, vendors, participants, and any individuals involved in the Scheduled Service Date.

Creative Portfolio & Media Usage

Unless otherwise agreed within the Service Agreement, Divìn Artistry reserves the right to photograph, record, publish, and use completed work, final deliverables, behind-the-scenes content, photographs, videos, and other media created during services for portfolio, educational, promotional, advertising, publication, website, and social media purposes.

This includes, but is not limited to:

  • Makeup artistry

  • Bridal transformations

  • Photography galleries

  • Videography projects

  • Production content

  • Editorial work

  • Creative campaigns

Clients who prefer not to have their likeness, event, project, or completed work used for promotional purposes must notify Divìn Artistry in writing prior to the Scheduled Service Date.

Any approved restrictions regarding media usage must be documented within the applicable Service Agreement.

Agreement Acknowledgement

By submitting payment, signing a Service Agreement, or otherwise booking services with Divìn Artistry, the Client confirms that they have read, understood, and agreed to all terms and conditions outlined within these Terms of Service.

The Client acknowledges that all information provided to Divìn Artistry is accurate, complete, and communicated in good faith.

The Client further acknowledges that they understand the services selected, payment obligations, timelines, cancellation policies, creative expectations, and responsibilities outlined within these Terms of Service and any applicable Service Agreement.

By proceeding with booking, the Client agrees to be bound by the policies and procedures established by Divìn Artistry.
